Terms of sale

The purpose of these general conditions of sale (the "GTC") is to define the terms of distance selling between the company Que Des Bonnes Vibes (the "Company") and any major user with the capacity to contract (the "Client").

The GTCs detailed below apply to all orders (the "Order") of products (the "Product") placed by the Customer via the website www.quedesbonnesvibes .com (the "Site"), owned by SAS Que Des Bonnes Vibes, simplified joint stock company with capital of € 2,000, registered with the RCS of Pontoise under number 879 035 046 and whose head office is located at 4, chemin des cygnes 95800 Courdimanche, France.

The Site is hosted by the company 1 & 1 IONOS SARL. It is accessible to all users of the Internet network in principle 24 / 24h, 7 / 7d, except interruption, scheduled or not, by the Company or its service providers, for the needs of its maintenance and / or security or in case of force majeure (defined below).

The Products offered for sale are available on the Site. They are accessible by the Customer, within the limit of available stocks. The availability of each product is indicated in real time on the product sheet.
However, any error in the update, whatever its origin, does not engage the responsibility of the Company. The Company cannot be held responsible for the cancellation of an order for a product due to exhaustion of stocks.
The Company strives to display in the presentation and description of its Products a representation as faithful as possible to reality in order to best satisfy the Customer's information. However, the photographs appearing on the Site have no contractual value, which the Customer acknowledges and accepts.

The prices applied to the Products are communicated on the site and confirmed to the Customer during the validation of the order.
The prices of the products are indicated in euros, all taxes included (TTC) except delivery costs; the value added tax (VAT) is that in force in mainland France on the day the order is confirmed; VAT remains the responsibility of the customer unless otherwise stated or special conditions.

The delivery costs will be calculated according to the carrier chosen by the Customer when ordering.
In the event of delivery outside mainland France, administrative and / or customs fees may be applied by the carrier.

The Products remain the property of the Company until full receipt of the price of the Products by the seller. The transfer of the risks of loss and deterioration of the products will be effective after delivery and receipt of the Products by the Customer.

The Company reserves the right to modify the prices at any time but undertakes to apply the prices indicated on the site at the time of the Customer's Order
If an erroneous price, obviously derisory, is displayed for any reason (computer bug, manual or technical error.), the order - even validated - will be canceled, for which the Company will inform the Customer as soon as possible. Taking an Order is subject to compliance with the procedure set up by the Company on the Site comprising successive steps leading to the validation of the Order.
The Customer can select as many Products as he wishes which will be added to the basket (hereinafter: the "Basket"). The Basket summarizes the Products chosen by the Customer as well as the related costs. The Customer may freely modify the Basket before validating his Order.
The Customer chooses his mode of delivery (the price varies according to the selected carrier and according to the destination) then his mode of payment. They are then redirected to the secure payment site where they enter their banking information.
The final acceptance of the Order is therefore materialized by the validation of the Customer's banking information (bank card number, expiration date and cryptogram).
The Customer must enter his bank card number, its validity date as well as the visual cryptogram (three digits) appearing on the back of his card.
If the payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.
A confirmation email summarizing the Order (Product (s), price, availability of Product (s), quantity, delivery method, etc.) will be sent to the Customer by the society. For this purpose, the Customer formally accepts the use of electronic mail for the confirmation of the Order.

The validation of the Order constitutes confirmation of the acceptance by the Customer of the GTC, the Products purchased, their price as well as the associated costs.
Please note that the Company reserves the right not to validate the Order in the event of:

- abnormal or abusive exchanges and returns,
- existing dispute (s) with the Customer.

The price of the products purchased is payable in cash, in full, on the day the Order is placed by the customer.
Payment is made online, in euros. The Company accepts the following payment methods: by credit card (Visa, Mastercard) and via PayPal.
All purchases made on www.quedesbonnesvibes.com are protected and secure 7 days a week, 24 hours a day.
By clicking on the bank card of their choice, the Customer will be redirected to the secure payment site (Mollie) which incorporates the SSL security standard During payment, the Customer enters his card number , its validity date and the cryptogram on the back of it.
This data is automatically encrypted (SSL protocol) and verified to prevent any abuse or fraud.
The Customer's bank account corresponding to the bank card used for payment is debited on the day the Order is confirmed by the Company.

In the event of a payment default, an incorrect address or any other problem involving the responsibility of the Customer, Que Des Bonnes Vibes reserves the right to block the Customer's Order until the problem is resolved.

Que Des Bonnes Vibes offers home delivery anywhere in the world. Delivery is provided by the carrier chosen by the Customer when finalizing his Order.
European Union and Switzerland: Delivery times are estimated at 6-7 working days from the dispatch of the Order.
Rest of the world: Delivery times are estimated at 9-10 working days from the dispatch of the Order.
Any order for a personalized product requires an additional period of up to 3 days.
The delivery costs will be calculated according to the carrier chosen by the customer when ordering.
In the event of delivery outside mainland France, administrative and / or customs charges may be applied by the carrier.
France, European Union, Switzerland and Rest of the world: < / b> Delivery is free for all orders of € 60.00 and over.

The delivery is made to the delivery address indicated by the Customer, it being specified that this address must be the residence address of the Customer, of a natural person of his choice or of a person moral. Delivery cannot be made to hotels or PO boxes.
In order for the delivery deadlines to be respected, the Customer must ensure that they have communicated exact and complete information concerning the delivery address (in particular: street number, building, staircase , access codes, names and / or intercom numbers, etc.).

If delivery is impossible due to an incorrect delivery address, the Customer must immediately contact Que Des Bonnes Vibes in order to report the incident. No reshipment can be made and the Customer will be reimbursed within five days of notification of the incident by the Customer to the Company.

The Company cannot be held responsible for the delay in delivery that is not its fault or justified by a case of force majeure (defined below).

If the delivery time is exceeded, the Customer may request the cancellation of the sale and obtain, within a maximum period of fourteen days following his request, the reimbursement of the sums paid on the occasion of the Ordered. Notwithstanding the above, the Company cannot be held responsible for any damage resulting from a delay in delivery. Any form of compensation other than reimbursement of the Product by the Company "is expressly excluded.

Right of withdrawal
In accordance with article L 121-20 of the Consumer Code, the Customer has a period of fourteen days from receipt of the items ordered to exercise his right of withdrawal without having to justify reasons or to pay penalties No withdrawal formulated beyond this period will be taken into account. If the customer uses his right of withdrawal, Que Des Bonnes Vibes will immediately send him an acknowledgment of receipt of the withdrawal as well as a voucher for a free return. Once printed, you will have to affix this voucher to the package and drop it off at a post office. Free returns only apply to shipments to mainland France.
Any shipment made by the customer himself, without using the return form, will not give rise to reimbursements for the delivery costs of this return. These will therefore be the responsibility of the Customer. The first shipment of the Product remains the responsibility of the Customer and will therefore not be refunded.

Personal data
The personal data entered by the Customer on the Site, necessary for the processing and delivery of the Order, are exclusively processed by Que Des Bonnes Vibes or its partners after express consent of the client.
Que Des Bonnes Vibes has declared the file including personal data relating to the Site's customers to the Commission Nationale Informatique et Libertés (declaration N ° 1235194 in accordance with the provisions of the Data Protection Act of January 6, 1978).

Intellectual property

Limitation of liability

Force majeure

These general conditions of sale are subject to French law.
